These terms apply to every purchase made through this website. By completing checkout you accept them.

2. What you are buying

You are buying a licence to use the software, not the software itself. Ownership of the plug-in, its source code and everything in it stays with Prime Entity.

The licence is:

  • Perpetual. It does not expire and does not need renewing.
  • Personal and non-exclusive. It is tied to the account created with the email address you gave at checkout.
  • Active on one computer at a time. You may install the software wherever you like, but it runs activated on a single machine. You can move it yourself, as often as you want, from your account page.
  • Usable commercially. Music you make with it is entirely yours. There are no royalties, credits or restrictions on what you release.

Activation happens once, over the internet. After that the software checks its licence locally and does not contact us again, so an internet connection is not needed to use it.

What you may not do:

  • Share your account details, or let other people activate on your licence.
  • Resell, rent or sublicence the software or your account.
  • Remove or work around the licence check.
  • Reverse engineer, decompile or disassemble the software, except where the law expressly allows it.

You are responsible for keeping your password to yourself. Tell us at support@prime-entity.nl if you think somebody else has it, and we will reset it and clear any active machines.

3. Price and payment

Prices are shown excluding VAT. Where VAT applies it is calculated and added at checkout based on the country you tell us you are in, and shown before you pay.

Payment is handled by Paddle, who act as the merchant of record. We never see or store your card details. An introductory or promotional price applies only while it is displayed on the product page.

4. Delivery

Delivery is automatic and by email, normally within a minute of payment being confirmed. You receive:

  • a link to choose a password for your account, and
  • a download link for the installer, valid for 48 hours.

You then activate the software by signing in inside the plug-in. If the download link expires or you forget your password, both can be replaced from the website at any time without contacting us.

5. Right of withdrawal

Under EU consumer law you normally have 14 days to withdraw from a distance purchase. That right does not apply to digital content that is delivered immediately, once you have expressly agreed to immediate delivery and acknowledged that you lose the right of withdrawal by doing so.

You give that agreement at checkout, before paying. This is why we are explicit on the product page about what does and does not run: please check the system requirements before you buy.

6. Refunds

The statutory withdrawal right being waived does not mean no refunds. If the software does not work on a system that meets the stated requirements, and we cannot fix it for you within a reasonable time, you get your money back. Email support@prime-entity.nl and tell us what happens.

A free demo of the full plug-in is available before purchase, without a time limit, precisely so you can establish that it works for you first.

7. System requirements

Requirements are listed on each product page and are part of these terms. At the time of writing, ReFolvk requires macOS 11 or later on an Apple Silicon processor. It does not run on Intel Macs and there is no Windows version.

The installer is not currently signed with an Apple Developer ID, so macOS reports it as coming from an unidentified developer on first open. Instructions for getting past that are in the read-me and in the FAQ.

8. Updates

Updates within the same major version are free and your activation carries over, so you do not have to sign in again. We are not obliged to release updates, to keep supporting any particular operating system version, or to keep a product on sale. If a future major version is a paid upgrade, we will say so clearly in advance.

9. Liability

The software is supplied as it is. We do not warrant that it is free of defects or that it will be uninterrupted, and to the extent the law permits we are not liable for indirect or consequential loss, including lost work, lost recordings or lost income.

Our total liability for any claim is limited to the amount you paid for the product. Nothing in these terms limits liability for death, personal injury, intent or gross negligence, or any other liability that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

Keep backups of your work. Audio software runs inside your DAW, and no plug-in vendor can guarantee what another piece of software does with your session.

10. Changes to these terms

We may change these terms for future purchases. The version that applies to your order is the one published at the time you bought, and the date above tells you which that is.

11. Applicable law and disputes

Dutch law applies. Disputes go to the competent court in the Netherlands, unless mandatory consumer rules give you the right to bring a claim where you live.

Talk to us first: support@prime-entity.nl. Most things are a misunderstanding that takes one email to resolve. EU consumers can also use the European Commission's online dispute resolution platform.
